Terms of Service for Orbb

1. Acceptance of Terms

By accessing or using the Orbb mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Orbb ("Company," "we," "our," or "us").

2. Description of Service

Orbb is a bookmark management application that allows you to:

• Save and organize web content, videos, and other online resources
• Search your bookmarks using natural language AI
• Access bookmarks across devices
• Integrate with Instagram DMs for quick bookmarking
• Enrich content with metadata from third-party services (TMDB, YouTube)

3. Account Registration

3.1 Account Creation

• You must create an account using Google Sign-In to use Orbb
• You must be at least 13 years old to create an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

3.2 Account Termination

• You may delete your account at any time through the app settings
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon termination, your data will be permanently deleted within 30 days

4. User Content

4.1 Your Bookmarks

• You retain all rights to the content you bookmark
• By using Orbb, you grant us a limited license to store and display your bookmarks
• We may analyze bookmark content to provide search and organization features
• Bookmarks may be processed through third-party APIs (TMDB, YouTube, Gemini AI)

4.2 Content Restrictions

You agree NOT to use Orbb to save or share content that:

• Violates any law or regulation
• Infringes on intellectual property rights
• Contains malware, viruses, or harmful code
• Is defamatory, obscene, or offensive
• Violates the rights of third parties
• Promotes illegal activities

5. Subscription Plans and Payments

5.1 Free Plan

• 20 bookmarks per day
• 10 AI searches per month
• Standard processing speed

5.3 Payment Terms

• All payments are processed through Apple In-App Purchases
• Prices are in U.S. Dollars and may vary by region
• Subscriptions automatically renew unless canceled at least 24 hours before the current period ends
• Your Apple account will be charged within 24 hours prior to the end of the current period
• No refunds for partial subscription periods

5.4 Price Changes

• We reserve the right to modify subscription prices with 30 days' notice
• Price changes will not affect current subscription periods
• You can cancel your subscription before the price increase takes effect

5.5 Cancellation

• You can cancel your subscription at any time in iOS Settings → [Your Name] → Subscriptions
• Cancellation takes effect at the end of the current billing period
• You will retain Premium benefits until the subscription expires
• No refunds will be issued for the remaining days of a subscription period

5.6 Refunds

• Refund requests must be submitted to Apple Support
• We do not have the ability to process refunds directly

6. Instagram Integration

6.1 @nextrabot

• You can send direct messages to @nextrabot on Instagram to create bookmarks
• You must link your Instagram account to use this feature
• We only access messages sent directly to @nextrabot
• Instagram's Terms of Service and Privacy Policy apply

6.2 Instagram Account Linking

• Linking is optional
• You can unlink your Instagram account at any time in app settings
• Unlinking will disable DM-based bookmarking but will not delete existing bookmarks

7. Acceptable Use Policy

You agree to use Orbb only for lawful purposes. You agree NOT to:

• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools (bots, scrapers) to access the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Interfere with or disrupt the App's functionality
• Use the App to store or distribute spam or malware
• Violate any applicable laws or regulations
• Circumvent usage limits (e.g., creating multiple accounts)

8. Intellectual Property

8.1 App Ownership

• Orbb and all related trademarks, logos, and service marks are owned by the Company
• The App's design, code, and functionality are protected by copyright and intellectual property laws
• You are granted a limited, non-exclusive, non-transferable license to use the App

8.2 Feedback

• If you provide feedback or suggestions, you grant us a perpetual, royalty-free license to use them
• We are not obligated to implement any feedback

9. Disclaimers

9.2 Service Availability

• We do not guarantee uninterrupted or error-free service
• We may suspend service for maintenance or updates without notice
• We are not liable for data loss due to service interruptions

9.3 Third-Party Content

• We do not endorse or take responsibility for bookmarked content
• Metadata provided by third-party APIs (TMDB, YouTube) may be inaccurate or incomplete

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Sending a push notification (for significant changes)

Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Termination

12.1 By You

You can delete your account at any time through the app settings.

12.2 By Us

We may terminate or suspend your account immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the service or other users
• Do not pay subscription fees

13. Apple Terms

13.1 Acknowledgement

These Terms are between you and Orbb only, not Apple. Apple is not responsible for the App or its content.

13.2 Maintenance and Support

Orbb is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide support.

13.3 Warranty

Apple is not responsible for any warranty claims. In the event of failure to conform to any warranty, you may notify Apple for a refund, and Apple will have no other warranty obligation.

13.4 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
